Welcome to adorationpeonygarden.com. By accessing or using this website and placing an order, you agree to these Terms of Service. Please read them carefully. If you do not agree, do not use this website or place an order.

1. About Our Products
Adoration Peony Garden, LLC offers peony root gifts and curated root collections, including The Peony Story Root Gift and The Peony Season Root Sets. Our roots are sourced from small family farms across the United States, USDA inspected at harvest, and fulfilled in the fall. Adoration Peony Garden, LLC is certified as a nursery dealer by the Illinois Department of Agriculture, Certificate No. 519-8120.
2. The Gift Model - Occasion-Date Notification and Deferred Shipment
Our gift products are designed so that the recipient experience is delivered in two phases:

Phase 1 - Occasion-date notification: On the date you select at checkout, your designated recipient will receive a notification email informing them of their peony root gift. This notification is delivered by Adoration Peony Garden via Klaviyo. This notification date may occur weeks or months before the root ships.

Phase 2 - Fall shipment: Peony roots are harvested and shipped in the fall, generally October through November, subject to weather conditions and harvest timing. Instructions for updating the recipient's shipping address prior to fulfillment are included in the occasion-date notification email.
By placing an order, you acknowledge and agree that: (1) the occasion-date notification and the physical shipment are separate events; (2) the root will not ship on the occasion date; and (3) harvest and shipment timing is subject to change due to weather and growing conditions.
3. Variety Availability and APG Substitution Policy
Adoration Peony Garden sources roots from small family farms across the United States. While we make every effort to fulfill ordered varieties, peony root availability is subject to conditions beyond our control, including crop yield, weather, and harvest outcomes at the farm level.
If the variety you ordered is not available at the time of fulfillment, we will contact you by email to offer either: (a) the opportunity to select a different available variety, or (b) a full refund of the purchase price. We will not substitute a different variety in place of your selection without your explicit written consent.
We do not substitute varieties for return or exchange purposes. If a return is approved under our return policy (see Section 7), the original order amount will be refunded or credited as applicable - a different variety will not be substituted in its place.

4. Pre-Order and Cancellation Policy
Adoration Peony Garden operates on a pre-order model. Orders are placed in advance of fall harvest and shipment. The following cancellation schedule applies:

On or before August 15: You may cancel your order for a full refund. No fees will be charged.

After August 15 and prior to shipment: Orders may be canceled, but refunds will not be issued. Instead, the full value of your order will be issued as an Adoration Peony Garden gift card, which may be applied to a future order.

After shipment has been initiated: Orders cannot be canceled. Please refer to our return policy in Section 7.

To cancel an order, contact us at hello@adorationpeonygarden.com with your order number. Cancellation requests are processed in the order received and are not confirmed until you receive a written response from us.
5. Address Updates for Gift Recipients
Because peony roots ship in the fall, potentially months after the occasion-date notification, the occasion-date notification email sent to the gift recipient will include instructions for how to update the shipping address on file prior to fall fulfillment. It is the responsibility of the gift purchaser to ensure that a valid email address is provided for the recipient at the time of order.
If the shipping address needs to be updated for any reason, the recipient or purchaser may submit a request by emailing hello@adorationpeonygarden.com prior to shipment. The request must include the order number and the name of the purchaser on the original order. An address update is not confirmed until the requestor has received written confirmation from Adoration Peony Garden. Address updates cannot be guaranteed once a shipment has been initiated.
If a package is returned to us due to an undeliverable address provided at checkout - including an address that was not updated prior to shipment - additional shipping fees will apply to reship the order. Adoration Peony Garden is not responsible for loss of perishable product resulting from delivery failure due to an incorrect or outdated address.

6. Shipping
Adoration Peony Garden ships peony roots in the fall, generally during October and November. All shipment timing is dependent on harvest conditions, which are subject to weather and growing circumstances beyond our control. We will communicate estimated shipping windows to customers and will notify you when your order ships.
We ship to addresses within the contiguous United States only. We do not ship to Alaska, Hawaii, U.S. territories, or international destinations. Peony roots must be shipped during the appropriate fall planting window to ensure viability. For this reason, we do not ship outside of our established fall fulfillment period. Risk of loss transfers to the buyer upon delivery to the shipping carrier.
We do not offer shipping insurance. Once your order has been delivered to the shipping carrier, Adoration Peony Gardenβs liability is limited to the terms described in these Terms of Service.
7. Return, Claim, and Replacement Policy
Peony roots are living, perishable plant material. Due to this perishable nature, our return and claim policy is time-sensitive and strictly enforced.
Initiating a Claim
Any claim regarding a damaged, defective, or otherwise unsatisfactory root must be initiated within three (3) calendar days of delivery. To initiate a claim, contact us at hello@adorationpeonygarden.com with: (1) your order number, (2) a written description of the issue, and (3) clear photographs of the root and its packaging as received. Claims submitted after the three (3) day window will not be eligible for refund or replacement.
Approved Returns
If your claim is approved and a return is required, return shipping must be initiated within two (2) business days of our written approval. Return shipping instructions will be provided at that time. Do not plant the root and do not remove any attached variety labels prior to return. Roots that have been planted are not eligible for return under any circumstance.
This policy is structured specifically because peony roots are perishable. A root that is not returned and replanted within its planting window loses viability rapidly. Strict timeframes protect both the integrity of the product and the customerβs ability to plant on time.
Non-Perishable Gift Components
Non-perishable items included in gift orders (such as vases or keepsake packaging) may be subject to a separate return window. Contact us at hello@adorationpeonygarden.com for assistance with non-root components.
8. Buyer Responsibilities Upon Delivery
Upon delivery, the buyer or recipient is responsible for:

Opening the package promptly upon delivery and inspecting the root

Following the enclosed planting instructions immediately or storing the root in a cool, dry, dark place (such as a basement or garage) until it can be planted. Even when stored under appropriate conditions, peony roots remain perishable and are at risk of deterioration over time. The root should be planted as soon as possible after delivery.

Planting the root in the fall before the ground freezes in your area

Adoration Peony Garden is not responsible for root failure resulting from delayed opening of the package, improper storage, failure to follow planting instructions, or any circumstances arising after delivery has been confirmed.
9. Post-Delivery Loss
Adoration Peony Gardenβs responsibility for your order ends upon confirmed delivery to the shipping address. We are not responsible for packages that are lost, stolen, or damaged after confirmed delivery. We do not offer shipping insurance. If you are concerned about package security at your delivery address, we recommend taking appropriate precautions to ensure prompt retrieval of delivered packages.
10. Perishable Products - Planting Requirements and Growing Results
Peony roots are living plant material. Their long-term performance depends on factors outside Adoration Peony Gardenβs control, including soil conditions, planting practices, climate, and growing zone compatibility.
Peony roots grown from bare roots may require one to three (1β3) years to produce their first bloom. Adoration Peony Garden does not guarantee specific bloom timing, bloom size, or bloom quantity in any given season. We are not responsible for plant loss or performance issues resulting from any of the following:

Weather conditions, including but not limited to late freezes, drought, excessive rain, or other climate events

Zone incompatibility: Peonies grow best in USDA Hardiness Zones 3β8. It is the buyerβs responsibility to confirm their growing zone prior to placing an order. We will not replace roots lost due to zone incompatibility.

Neglect, improper care, or failure to follow planting instructions

Damage caused by animals, pests, or disease after planting

Performance in seasons following the first bloom year
11. Pricing and Payment
All prices are listed in U.S. dollars and are subject to change without notice prior to order confirmation. Payment is processed securely through Shopify Payments. By placing an order, you authorize us to charge your payment method for the total amount of your order, including applicable taxes and shipping fees. We do not store full payment card information.
12. Intellectual Property
All content on this website - including text, photographs, brand elements, product names, The Peony Story concept and associated storytelling, the Adoration Peony Garden name and mark, and the APG brand identity - is the property of Adoration Peony Garden, LLC and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or use our content for commercial purposes without prior written permission.
13. User Submissions
If you submit reviews, stories, photographs, or comments to us or tag us on social media, you grant Adoration Peony Garden, LLC a non-exclusive, royalty-free, perpetual right to use, reproduce, and display that content on our website and in marketing materials. You represent that you own or have the right to share any content you submit and that it does not infringe on the rights of others.
14. Prohibited Use
You agree not to use this website to: (a) violate any applicable law or regulation; (b) transmit harmful, offensive, or fraudulent content; (c) attempt to access systems or data you are not authorized to access; (d) interfere with the operation of the website or related services; or (e) impersonate any person or entity.
15. Right to Deny Service
Adoration Peony Garden reserves the right to refuse, cancel, or limit service to any person, at any time, and for any reason, as permitted by applicable law. This includes the right to cancel orders, limit quantities, and restrict access to our website or products at our sole discretion.
16. Third-Party Services
Our website and order fulfillment process rely on third-party platforms including Shopify, Klaviyo, ShipStation, and others. We are not responsible for the availability, accuracy, or conduct of these platforms. Use of these services is also subject to their respective terms of service and privacy policies.
17. Disclaimer of Warranties
This website and its content are provided βas isβ without warranties of any kind, express or implied. We do not warrant that the website will be continuously available, error-free, or free of viruses. To the fullest extent permitted by law, we disclaim all warranties regarding the accuracy, completeness, or fitness for a particular purpose of any content on this site.
18. Limitation of Liability
To the fullest extent permitted by applicable law, Adoration Peony Garden, LLC and its owners, employees, and agents are not liable for any indirect, incidental, special, or consequential damages arising from your use of this website, your order, or your reliance on any content herein. Our total liability to you for any claim arising out of or related to your order shall not exceed the amount you paid for the order giving rise to the claim.
19. Indemnification
By using this website and placing an order, you agree to indemnify and hold harmless Adoration Peony Garden, LLC and its owners, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of this website; (b) your breach of these Terms of Service; or (c) your violation of any applicable law or the rights of any third party.
20. Severability
If any provision of these Terms of Service is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions of these Terms of Service shall continue in full force and effect.
21. Governing Law and Dispute Resolution
These Terms of Service are governed by the laws of the State of Illinois, without regard to conflict of law principles. Any dispute arising out of or related to these Terms or your use of this website shall be subject to the exclusive jurisdiction of the state and federal courts located in Champaign County, Illinois. You agree to submit to the personal jurisdiction of those courts.
22. Changes to These Terms
We may update these Terms of Service from time to time. Changes will be posted on this page with an updated Effective Date. Your continued use of the website after changes are posted constitutes your acceptance of the revised terms. For material changes, we will provide reasonable notice, which may include an email notification.
